Italy’s center-left government adopted a draft bill that would grant legal status to gay couples

The legislation, though promised by the coalition in its election manifesto last year, was the subject of protracted debate within the government, which includes far-left components as well as centrist Catholics.

The law, bitterly opposed by the Roman Catholic Church, would apply to unmarried couples regardless of sexual orientation. “It’s the first time in the legislation of our country that people who live together, heterosexual or homosexual, will have their basic rights recognized,” Piero Fassino of the Democrats of the Left party told a news conference.

The bill “allows the recognition of the rights of those who live together by making this cohabitation more serene and solid, and at the same time respecting the Italian constitution, which guarantees that the family is founded on marriage,” he said.

The Church and the Vatican see the planned legislation as an attack on the concept of marriage as the union of a man and a woman, while two-thirds of Italians favor the measure, according to a poll carried out last month. To satisfy all components of the ruling coalition, the new legislation will result in far less robust civil unions, or PACS, than those that exist elsewhere in Europe.

In addition to health and social benefits, inheritance entitlements will be assured after partnerships lasting at least nine years and rental contracts will be protected after three years, Equal Rights Minister Barbara Pollastrini said at the news conference following an extraordinary cabinet meeting.

A minimum duration of a union in order for a pension to continue to be paid to a surviving partner has yet to be decided. Under the law, unmarried gay or heterosexual couples would also be accorded some of the rights enjoyed by conventional couples such as hospital and prison visitation rights.

Justice Minister Clemente Mastella, who heads a small Christian Democrat party in the coalition and has repeatedly spoken out against the bill, did not attend the cabinet meeting.

Vaticaan tegen mogelijke erkenning homo-huwelijk in Italië

De beslissing van de Italiaanse regering om voor eind januari wetgevende teksten te maken over het homohuwelijk lokt fel protest uit van het Vaticaan. De Osservatore Romano, het huisorgaan van het Vaticaan, verwijt premier Romano Prodi het gezin te willen uitroeien.

Romano Prodi, een praktiserend katholiek, blijft bij zijn standpunt. Hij is helemaal niet blij met wat over hem in de Osservatore Romano geschreven werd. De minister van Volksgezondheid, Livia Turco, bestempelt de kritiek op een project dat discriminaties wil uitschakelen als “onaanvaardbaar”.

Inmiddels blijft de Kerk zwaar wegen op het politieke leven in Italië. Links wil dat een aantal ethische kwesties worden behandeld waar het Vaticaan helemaal niet gelukkig mee is.

Prodi heeft de stemmen van de katholieken nodig. De regering zou over een aantal ethische kwesties zoals euthanasie kunnen vallen, aldus ingewijden.

Italiaanse Senaat eist homo-huwelijk

De Italiaanse Senaat heeft donderdag een motie goedgekeurd die de regering van premier Romano Prodi oproept om een wet in het leven te roepen die een burgerlijke unie mogelijk maakt voor homo’s en lesbische koppels.

De motie bepaald ook dat de wettekst er al eind volgende maand moet zijn.
De motie citeert “het groeiende debat bij politici en de publieke opinie over de geldende huwelijkswetten en de rechten en plichten die hieruit voortvloeien'’ en bepaalt dat de wettekst “de rechten, waaronder de belastingen van de betrokken personen” moet erkennen.

De motie komt er een dag nadat de stad Padua beslist heeft om een register in het leven te roepen waarin samenwonende homoseksuele en ongetrouwde hetero-koppels hun relatie kunnen registreren.

Prodi zelf is geen voorstander van een homo-huwelijk zoals wij dit kennen. Hij is eerder een voorstander om een soortgelijk register in het leven te roepen zoals dat van Groot-Brittanie. Het Vaticaan heeft in het verleden al laten weten tegen iedere vorm van een partnerschapregeling voor homoseksuelen.
